Judgment: March 19, 2012
The accused was traveling at an extreme rate
of speed on a busy city street while impaired by alcohol. Three people died and one
passenger suffered life-threatening injuries. The accused was 23 years old and
unemployed due to an historic injury. He had a criminal record, and was subject to
a deportation order as a result of the prior convictions.

The ten-year sentence sought by the Crown did not align with precedent establishing an
appropriate range of sentence, even for particularly egregious drinking and driving offences.
Considering the numerous aggravating factors, including the high blood-alcohol
level of the accused, his extremely dangerous driving and his prior record, a sentence
at the high end of the established range, or a global sentence of eight years,
appropriately reflected the principles of denunciation and deterrence.
